Terms of Service

The rules for using our site and buying from us.

These terms cover your use of duttonbrown.mom and anything you buy from us. "Dutton Brown," "we" and "us" mean Dutton Brown Design, LLC, 1995 Oakcrest Avenue, Roseville, Minnesota 55113. "You" means the person or business using the site or placing the order.

Last updated: October 19, 2026

By using the site, creating an account or placing an order, you agree to these terms. They work together with our Return Policy, Shipping Policy, Privacy Policy and Quote Terms. If one of those pages covers a topic in more detail, that page controls for that topic.

Ordering

Who can buy
  • You must be at least 18, or the age of majority where you live, to place an order. If you order for a business, you confirm you can bind that business to these terms.
  • We ship to the United States and Canada.
  • We may decline, limit or cancel any order, including orders that look fraudulent or break these terms. If we cancel an order you paid for, we refund it in full.
Your account

You don't need an account to check out. With one, you can see orders and tracking, start returns, download invoices, and use trade pricing if you're approved.

  • Sign-in: there are no passwords. Enter your email and we send you a six-digit code. Keep your email secure, since anyone who can read it can sign in as you.
  • Your info: keep your name, email, phone and addresses current.
  • Your activity: you're responsible for orders placed from your account. Tell us right away at [email protected] if you think someone else used it.
  • Closing accounts: we may suspend or close an account that breaks these terms or is used for fraud.
Made to order

Everything we sell is made to order in our studio. We don't hold finished stock, so production starts as soon as you order.

  • Lead times are listed on each product page. They are estimates and may change.
  • Late orders: if we cannot ship by the lead time we gave you, we'll tell you the new date. You can then cancel for a full refund of everything you paid, including all fees, with no cancellation fee. On orders of 10 or more items, we'll contact you up front if we can't meet the listed lead time.
  • Holds: to ship on a later date, add a note at checkout or contact us.
  • Finishes vary. Solid brass and polished nickel change over time. Colors on screens differ from the product. Small differences from what you see online are not a defect. Samples are available.
  • Custom colors: beyond our signature colors, we match a powder coat color for $500 per color, which covers every item on the order in that color. Custom color lead times are longer and depend on powder availability. Custom color items are final sale.
  • Custom design: we do not accept one-off custom design requests.
Changes and cancellations
  • Within 48 hours of ordering: change or cancel at no charge.
  • After 48 hours: if assembly has started, a 10% fee on the changed or cancelled items may apply. For a cancellation, we take it out of your refund. The fee never applies when you cancel because we're running late.
  • Adding items: we can add items within 48 hours. After that, it depends on how far along your order is. If it's about to ship, we'll ask you to place a new order.
  • A cancelled order can't be restarted. Place a new order instead.

Email [email protected] with your order number and the change you want.

Expedited manufacturing
  • Add it at checkout to move your order to the front of our queue and ship it within one week.
  • It costs $150 or 30% of the order's retail value, whichever is greater.
  • It covers assembly time only, not faster shipping. It is non-refundable, except when you cancel because we're running late, and discounts don't apply to it.
  • For large orders we'll confirm a lead time with you. If you need it by a certain date, say so in the order note and we'll tell you whether we can make it.
Prices and errors
  • Prices are in US dollars and can change at any time. The price at checkout, or on your issued quote, is the price you pay.
  • Product details, prices and availability can contain mistakes. If we find a price or product error after you order, we'll contact you before we build it. You can accept the corrected order or cancel for a full refund.
  • We may stop selling any product at any time.

Payment and quotes

Payment
  • All orders are paid in full before production starts. We accept major credit cards, Apple Pay, Google Pay, Meta Pay, PayPal, Amazon Pay, check, ACH and wire transfer.
  • Card fee on large purchase orders: purchase orders of $10,000 or more paid by card carry a 3% fee. Check, ACH and wire have no fee. Website checkout never carries a card fee.
  • Purchase orders: we send a proforma invoice. The order starts when payment clears.
  • Payment terms (such as net 30) exist only by written agreement with us. A purchase order that lists terms does not create them.
Sales tax
  • We collect sales tax on orders that ship to the states where we're registered. Sales tax for trade accounts lists those states. Tax is calculated at checkout.
  • Tax-exempt orders: send a completed, signed, current resale certificate for the ship-to state before you check out. We verify it and mark your account exempt for that state only. Orders placed before then include sales tax.
Quotes and draft orders
  • Anyone can request a quote. Every quote follows our Quote Terms.
  • Quotes are valid for 60 days unless the quote says otherwise. We honor an issued quote's prices through any price increase while it's valid.
  • A quote is not an order. It becomes an order when you pay it.
  • We often send quotes as a draft order, an emailed checkout link. These terms apply to draft orders the same as website orders.
  • Lead time on a quote starts when the order is paid.

Trade and business

Trade program

The trade program is for design and building professionals: interior designers, architects, contractors, stagers and similar trades.

  • Applying: we review applications within 1–2 business days. We may approve, deny or later remove trade status, including for false information or misuse.
  • Pricing: approved members see trade pricing automatically when signed in.
  • Trade pricing is for your business only. Do not share your account or extend trade pricing to the public. To have a client pay us directly at trade pricing, ask us to send them a draft order.
  • Samples: members get free samples in any quantity. You pay shipping.
  • Discounts don't stack. Trade pricing doesn't combine with promo codes. When two discounts can't combine, you get whichever saves you more. Expedite, custom color and Redo fees are never discounted.
Business accounts

Some customers buy through a company account with one or more locations and buyers.

  • The company is responsible for every order its buyers place.
  • Pricing can be set per company or location and may differ from website prices.
  • The company keeps its buyer list current. Tell us when someone leaves so we can remove their access.
  • A separate written agreement with your company, if there is one, controls where it conflicts with these terms.
Samples
  • Color and finish samples are sold at the price shown and are final sale.
  • After you buy a fixture, we refund what you paid for samples, minus shipping, if you ask. Email us your order number.
  • Your fixture may vary slightly from its sample.

Shipping and returns

Shipping and delivery

Details are in our Shipping Policy. In short:

  • We ship from Roseville, MN by FedEx, and USPS for small packages. Large orders may ship by freight. Delivery takes 1–4 business days once an order ships.
  • Free ground shipping offers apply to the 48 contiguous states only.
  • Canadian orders ship Delivered Duty Paid: duties and taxes are charged at checkout.
  • Check your shipping address. We can change it until the order ships. We're not responsible for orders sent to an address you gave us, or for rerouting fees.
  • Risk of loss passes to you when the carrier marks your order delivered. With package protection, lost, stolen and damaged packages are covered (see Returns, Redo and package protection below). Without it, we're not responsible for packages lost, stolen or damaged in transit, including packages marked delivered. We'll help you file a claim or trace with FedEx.
Returns, Redo and package protection

Full rules are in our Return Policy. In short:

  • Return windows: 45 days from delivery for lighting, 30 days for hardware. Items must be unused and uninstalled (no cut wires or scratches), in their original packaging.
  • Request first: a return must be approved before you ship it back. Once approved, you have 14 days to send it or the return closes.
  • Restocking fee: 20% on every return.
  • Return shipping: you pay for the label unless you bought Redo at checkout.
  • Final sale: bulbs, glass globes, pillow covers, sale items, samples, custom color items, items with non-standard add-ons such as switches or cords, items customized by request, large orders (5 or more of one light fixture style, or 10 or more of one hardware style), installed items, and all fees (expedite, custom color, shipping, Redo).
  • No exchanges. Return the item and place a new order.
  • Late orders: If you cancel because we cannot ship by the lead time we gave you, we refund everything you paid, including expedite, custom color, shipping and Redo fees. This overrides any "non-refundable" or "final sale" note on this page.
  • Refunds go back to the original payment method within a few business days after we inspect the return. Shipping is not refunded.
  • Redo is an optional add-on at checkout, run by Redo, a separate company. One non-refundable fee covers the whole order. It gives you free return labels for eligible items (all return rules still apply, including the restocking fee) and package protection: if a protected order is lost, stolen or damaged in transit, we replace it at no charge.
Damaged, wrong or missing items
  • Inspect your order when it arrives. Report damaged, defective, wrong or missing items within 30 days of delivery through our returns portal or at [email protected], with your order number and photos of the item and the box. We don't accept claims after 30 days.
  • Don't install a damaged item. Installing it ends your right to a replacement.
  • Defective, wrong or missing items: we'll repair, replace or refund, our choice.
  • Damaged in transit: covered if you bought package protection. Without it, we'll help you file a claim with FedEx.
  • Defects found later are covered by the Warranty below. The 30-day window doesn't shorten it.

Warranty and safety

Warranty

Every light fixture and hardware product we make carries a 2-year limited warranty against defects in materials and workmanship under normal use. It runs from the date of delivery and covers the original buyer in the United States or Canada. Our Warranty Certificate has the full terms.

  • We will repair or replace the defective product, our choice.
  • Not covered: damage from misuse, abuse, accidents or changes to the product (including repainting or recoating); improper installation, including use beyond the fixture's rated location; incompatible or oversized bulbs; improper cleaning or care; cosmetic wear from normal use, including the natural aging of brass and nickel; and bulbs and other resold accessories, which carry their maker's warranty.
  • Not covered: costs to install or remove a product, including electrician fees.
  • The warranty does not transfer to a later owner.
  • To file a claim, email [email protected] with your order number, a description and a photo.

This warranty gives you specific legal rights, and you may have other rights that vary by state or province. To the extent the law allows, any implied warranties (such as merchantability or fitness for a particular purpose) last only as long as this warranty. Some places don't allow that limit, so it may not apply to you.

Installation and safety
  • Our light fixtures are UL/cUL listed for dry locations. A fixture is damp rated only if its product specs say so. We don't make wet-rated fixtures.
  • Install fixtures to local electrical codes. We recommend a licensed electrician, and always for an ungrounded box. Fixtures are not compatible with low-voltage wiring.
  • Use only the bulb type and wattage listed for the fixture.
  • Stop using any fixture that is damaged, such as a cracked socket, and contact us.
Repairs
  • We repair or modify products we've sold. Simple repairs start at $50. For bigger repairs we'll agree on a plan first.
  • You arrange delivery to us and pickup.
  • We aren't responsible if a fixture can't be repaired because of earlier damage or misuse.

Files and content

CAD + 3D Library

Our CAD + 3D Library offers Revit families, SketchUp models, 3D views, tear sheets and install guides. The complete-library download is free for approved trade members and a one-time purchase for everyone else. That purchase is final.

Files you download from duttonbrown.mom remain ours. You may use them, at no charge, to plan, design, specify, render and present projects that use or may use Dutton Brown products, including in drawings, models and renderings you share with your clients and project team. You may not:

  • sell, share or post the files themselves, or add them to another library or marketplace
  • use them to make, or have made, copies or close copies of our products
  • remove our name or product details from them

Files are for planning only. Confirm sizes and specifications against the product page and tear sheet before you order or build. Models you get from Trimble 3D Warehouse or BIMobject are licensed under those sites' terms.

Our content and designs

The site's text, photos, video, product names, logos, product designs and files belong to Dutton Brown or our licensors and are protected by law. Do not copy, sell or reuse them without our written permission, except as these terms allow. You may link to our pages and share our product photos with credit and a link.

Reviews, photos and ideas
  • When you post a review, tag us, or send us photos of your project, you give us a free, worldwide right to use, edit and share that content to promote Dutton Brown. We credit you where we can. You confirm the content is yours to share and doesn't break anyone else's rights.
  • We may remove any content we think is unlawful, offensive or misleading.
  • If you send ideas or suggestions, we may use them freely, without owing you anything.
Rules for using the site

You may not use the site to:

  • break the law or anyone's rights
  • give false information, including on a trade application or tax certificate
  • send viruses or harmful code, or try to get around our security
  • overload the site, or run automated tools that ignore our robots.txt or harm the site
  • harass anyone, or collect other people's personal information
Other companies' services

We use outside services to run the store, including Shopify (store and checkout), Redo (returns and package protection), FedEx and USPS (shipping), payment providers, and Trimble 3D Warehouse and BIMobject (3D files). Their terms and privacy policies apply when you use them. We aren't responsible for their sites or services.

Privacy

How we collect and use personal information is in our Privacy Policy.

Legal

Disclaimer

Except for the written warranty above and as the law requires, the site and its content are provided "as is." We don't promise the site will always be available, error-free or secure.

Limits on our liability

To the fullest extent the law allows:

  • We aren't liable for indirect, incidental, special or consequential damages. That includes lost profits, project delays, installation or removal costs, and electrician or contractor fees, even if we were told they were possible.
  • Our total liability for any claim about a product or order is limited to the amount you paid for that product.

Some places don't allow these limits, so they may not fully apply to you. Nothing in these terms limits liability that can't be limited by law, such as for personal injury caused by our negligence.

Indemnity

If you break these terms or the law, and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, including attorney fees.

Governing law and disputes
  • Minnesota law governs these terms, without regard to conflict-of-law rules.
  • Before filing a claim, contact us at [email protected] so we can try to fix it.
  • Any lawsuit must be brought in the state or federal courts in Ramsey County, Minnesota, and you and we agree to those courts. Either side may use small claims court instead.
  • This section doesn't take away consumer rights you have under the laws where you live.
Changes to these terms

We may update these terms. We'll post the new version here with a new date. The terms in place when you place an order apply to that order. Using the site after a change means you accept the new terms.

General terms
  • If part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a term right away, we can still enforce it later.
  • You can't transfer your rights under these terms without our permission. We may transfer ours, for example if the business is sold.
  • We aren't responsible for delays caused by events outside our control, such as storms, carrier delays, supply shortages or power outages.
  • These terms, the policies linked above, and any written agreement you have with us are the whole agreement between us about the site and your orders.
Nothing on this page matches your search. Try different words or contact us.
